Welcome to SpeakUp. By using our web application at speakupcoach.com or our iOS app ("the Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service.

1. Eligibility

SpeakUp is open to users of all ages. If you are under 18, we encourage you to review these Terms with a parent or guardian before using the Service.

2. Account Responsibilities

You are responsible for maintaining the security of your account credentials
You must provide accurate information when creating your account
You are responsible for all activity under your account
Notify us immediately if you suspect unauthorized access to your account

3. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Upload harmful, offensive, or inappropriate content through speech recordings
Attempt to access other users' data or accounts
Interfere with or disrupt the Service
Use automated tools to access the Service (bots, scrapers, etc.)
Reverse engineer or attempt to extract source code from the apps

4. The Service

SpeakUp provides AI-powered public speaking coaching through structured lessons and free-form practice. The Service includes:

Speech recording and AI-powered analysis
Structured learning tracks with lessons
Progress tracking, scores, and performance analytics
Gamification features (XP, gems, streaks, awards, leaderboards)
Text-to-speech demonstration audio in lessons

5. AI-Generated Feedback

SpeakUp uses AI models to analyze your speech and provide feedback. This feedback is generated by machine learning systems and is intended as a practice tool, not professional coaching advice. AI feedback may not always be accurate. We make no guarantees about the accuracy, completeness, or suitability of AI-generated analysis.

6. Your Content

You retain ownership of any content you create through the Service, including your speech recordings and practice data. By using the Service, you grant us a limited license to process your audio recordings for the purpose of providing transcription and AI feedback. As described in our Privacy Policy, audio recordings are not stored after processing.

7. Intellectual Property

The Service, including its design, lessons, content, code, and branding, is owned by SpeakUp. You may not copy, modify, or distribute any part of the Service without our written permission.

8. Free & Paid Features

SpeakUp currently offers free access with certain limitations (e.g., score capping without AI features on web). We reserve the right to introduce paid plans, modify free tier limitations, or change pricing at any time with reasonable notice.

9. Availability

We strive to keep the Service available but do not guarantee 100% uptime. We may suspend or discontinue the Service (or any part of it) at any time without liability. We will make reasonable efforts to notify users of significant changes.

10. Account Termination

You can delete your account at any time from the Settings page
We may suspend or terminate your account if you violate these Terms
Upon deletion, all your data is permanently removed as described in our Privacy Policy

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. SpeakUp is not a substitute for professional speech therapy or coaching.

12. Limitation of Liability

To the maximum extent permitted by law, SpeakUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data or use, arising out of your use of the Service.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will update the "Last updated" date at the top of this page.
